Gas-station heroin products to be prohibited in New York

The FDA’s warning letters, Missouri’s lawsuit, and Florida’s emergency rule all center on isolated or enriched 7-OH in tablet, gummy, and shot formats — not on conventional ground-leaf powder and capsules. The expiring emergency rule applies to concentrated 7-OH — a separate category from the whole-leaf powder and capsules most consumers purchase. The AG’s office had sued the company in March, focusing in particular on concentrated 7-OH products it characterized as hazardous. On June 4, Missouri Attorney General Catherine Hanaway announced that Kansas City-based CBD American Shaman — described as the largest kratom distributor in the state — agreed to immediately suspend all in-state sales of kratom and 7-OH. With the law in force, Tennessee becomes the eighth U.S. state to fully prohibit kratom, joining Alabama, Arkansas, Indiana, Rhode Island’s earlier status, Vermont, Wisconsin, and others on the restricted list.

Most people start low and go slow to learn how their body responds. Sometimes referred to collectively as “gas station heroin,” the drugs have been restricted by several states, but they are not scheduled at the federal level. In recent months, the FDA has also issued warnings on other unapproved drugs sold as supplements or energy drinks, including the antidepressant tianeptine. An industry group, the American Kratom Association, has lobbied Congress for years against restrictions on the plant.

A new, purified compound from kratom called 7-hydroxymitragynine (also known as 7 hydroxy or 7-OH) is now being sold in pill form. In the U.S., kratom is legal in nearly all states and not federally regulated. Most users aren’t seeking a caffeine-like boost—they’re looking for the opioid-like effects to manage pain or avoid prescription opioids. Most kratom costs between $1.30 and $2.00 per 10 grams of powder. That said, the most potent kratom is reserved for the Maeng Da strains, which come in a few different varieties — Green Maeng Da, Red Maeng Da, and White Maeng Da. Strong kratom is the most likely to lead to adverse reactions and may be too much for sensitive people, and is the most likely to contain adulterants.

The Ohio Board of Pharmacy is still considering whether to ban natural kratom. The Joint Committee on Agency Rule Review approved naming synthetic kratom as a Schedule 1 controlled substance in Ohio. A panel of lawmakers approved the permanent ban on synthetic kratom, which is not regulated but is marketed as a dietary supplement and sold at specialty shops, convenience stores and gas stations.
